2. License and Usage Rights

a. License Grant

Genius IT Systems grants you a non-exclusive, non-transferable, limited license to install and use Elite Data Backup on your personal or business computer(s) solely for lawful purposes.

b. License Restrictions

You agree not to:

• Reverse engineer, decompile, or modify the software.
• Rent, sell, sublicense, or distribute the software.
• Use the software for unlawful or unauthorized activities.
• Interfere with or bypass any security mechanisms in the software.

Violation of these terms may result in immediate termination of your license.

3. Software Functionality

Elite Data Backup performs automatic and manual data backups from a user’s PC to cloud storage platforms such as Google Drive and Microsoft OneDrive.

Please note:

• We do not store or have access to your backed-up files.
• You are responsible for maintaining credentials and access to your cloud storage accounts.
• Backup performance may depend on your system configuration, internet connectivity, and third-party cloud service availability.

4. Intellectual Property

All intellectual property rights, including software code, logos, product names, graphics, and documentation, are the sole property of Genius IT Systems.

You may not reproduce, copy, or use our intellectual property without prior written permission.

5. User Responsibilities

By using our software or website, you agree to:

• Provide accurate and truthful information during registration or support requests.
• Ensure your system meets the technical requirements to run the software.
• Use the software in compliance with applicable laws and regulations.

You are responsible for safeguarding your login credentials and ensuring data integrity within your cloud storage accounts.

6. Disclaimer of Warranties

Our software and services are provided on an “as is” and “as available” basis. While we strive for accuracy and reliability, Genius IT Systems makes no warranties regarding:

• Continuous or error-free operation
• Compatibility with all systems or configurations
• Guaranteed data recovery or prevention of data loss
• Uninterrupted access to third-party services (Google Drive, OneDrive, etc.)

7. Limitation of Liability

To the fullest extent permitted by law, Genius IT Systems shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business interruption
• Failures caused by third-party cloud services

Your sole remedy for dissatisfaction with the software or website is to discontinue its use.

8. Updates and Modifications

We may release updates, enhancements, or bug fixes periodically. These may install automatically or require manual action.

We also reserve the right to modify or discontinue any part of our website or software at any time without prior notice.

9. Technical Support

We provide telephonic technical support for registered users of Elite Data Backup during standard business hours.

Support may include troubleshooting, configuration help, or diagnostics. However, we do not take responsibility for data loss resulting from improper usage or configuration.

10. Termination

We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination, you must uninstall the software and cease all use.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.

12. Amendments

We may revise these Terms periodically. Updated versions will be posted on our website with a revised effective date. Continued use of the Services constitutes acceptance of any changes.
